What is a Chapter 7?

Generally, a Chapter 7 Bankruptcy is a type of Bankruptcy you would file if you were looking to get a fresh start.  If you are have trouble paying credit cards, medical bills, payday loans or other unsecured debts then a Chapter 7 may be for you.  Chapter 7 is also called a liquidation form of Bankruptcy which just means that the Trustee will be looking at your assets to determine what if any assets they are allowed to sell to pay your creditors.  However, in most cases the Trustee is not able to sell any of your assets.  What typically will happen is that you will list all of your assets, debts, income and expenses in your Bankruptcy Schedules.  Then the Trustee will review those Schedules and ask you any questions they have concerning them.  Finally, you will receive a discharge of your dischargeable debts and give you a fresh start.  For specific questions and further information on a Chapter 7 please visit the Chapter 7 page or call us at 816-454-5555 and we can answer any questions you might have.

What is a Chapter 13?

A Chapter 13 Bankruptcy is an up to 60 month payment plan which pays back whatever debts are required by law.  Some people refer to a Chapter 13 as a consolidation or reorganization of your debts.  This is the type of Bankruptcy you would file if you are facing a foreclosure and you want to save your home.  In a Chapter 13 you will list all of your assets, debts, income and expenses in your Bankruptcy Schedules.  From those schedules we will calculate a Chapter 13 Plan.  In that Plan you can choose to pay on secured debts such as mortgages or car payments.  Any priority debts like taxes and child support will be listed in the plan to be paid.  The remainder of your debts may not be required to be paid at all.  That will depend on how much excess equity you have in assets and how much excess income that you have.  At the end of the Chapter 13 you can receive a discharge of many debts as well.  For specific questions and further information on a Chapter 13 please visit the Chapter 13 page or call us at 816-454-5555 and we can answer any questions you might have.

Which Bankruptcy is the one I should file?
